A 52-year-old trans-identified male convicted for the possession of sickening child sexual abuse materials has told a court that he viewed the material to assist in the development of his “gender identity.” The man, who has not been named due to Germany’s strict privacy laws, was granted a lenient sentence after a judge accepted his excuse.
News reports have used the false name Jürgen or Beate Kämmerer when referring to the pedophile, who had saved over 70 child and youth pornography files on various devices. Kämmerer appeared before the Hersbruck district court last Monday, where he presented his bizarre reasons for accessing the heinous material.
Kämmerer told the court that he “did not view the pornographic content with pedophilic intent or to satisfy a sexual desire,” reported Nürnberger Nachrichten, but instead to aid in his gender transition. Presiding Judge André Gläßl and the public prosecutor both accepted the reasons given by Kämmerer justifying his possession of child pornography.
At the beginning of December 2021, police officers discovered the illicit materials during a search of Kämmerer’s apartment, which was in a state of disarray at the time. A police officer described the premises during the hearing as giving the impression that he had “lost control of his life,” and noted that the conditions in Kämmerer’s apartment were so poor that a report was even made to the health department.
Investigators found 70 child and youth pornographic image files at Kämmerer’s home. One police officer summarized on the witness stand that the child pornographic content depicted children “posing partially clothed, but in a clearly sexualized form.”
Additionally, “naked genitals and sexual acts” involving minors could be seen in some of the images. One such image, for example, shows a 14 to 16-year-old girl performing oral sex on a much older man.
Kämmerer admitted to possession of child pornography, but claimed the content was “part of [his] transsexual history.” He told the court that he had identified as female from an early age and had endured a difficult childhood.
“I am truly sorry,” Kämmerer said. “I didn’t want to have sex with anyone.” Instead, he argued, he looked at the pornographic images to “catch up on something that had always been denied” to him.
The public prosecutor, who has not been named by the media, applauded Kämmerer for the confession, and accepted his argument that the pornography helped him “discover [his] identity.” The prosecution requested a sentence of one year and six months of probation, while Kämmerer’s defense attorney similarly asked for a sentence of one year probation.
Judge André Gläßl ultimately sentenced the man to one year and two months, but suspended the sentence so that it could be served in the community on the basis that the pornography did not depict “extreme” sexual acts.
