GERMANY: Transgender Pedophile Threatens Judge With “Misgendering” Fine For Revealing His Criminal Record In Court

A transgender pedophile in Germany is using the country’s new anti-misgendering laws to threaten a judge after the judge referenced the man’s past criminal history. In Germany, revealing a trans-identified individual’s former identity or misgendering them can result in criminal charges and fines up to €10,000.

Martin H., whose full name has not been released, was sentenced in Saxony in 2024 to 9 years and 4 months in prison for the aggravated sexual abuse of children, among other offenses. During his trial, Martin changed his name to “Chihiro Mirjam Bella” and started identifying as a woman.

Since being incarcerated in the Dresden men’s prison, Martin has been a problem inmate, racking up over 40 different violations since his admission. In the most recent incident, a routine cell search turned into a legal battle after Martin began verbally abusing the male correctional officer who was sent in to search his cell and pat him down. The child sex offender was handed a €400 fine for his behavior, but refused to pay it, resulting in the case being referred to a regional court for adjudication.

In court, Martin claimed that the insults had only been a reaction to the officer’s “defamatory groping.” Martin went on to argue that because he is legally female, he should have either been provided a female prison guard for the search, or simply be moved to the Chemnitz women’s prison.

Judge Andreas Feron, presiding over the appeal, argued that it would be “unreasonable” to move Martin to a women’s facility due to his extensive sexual criminal history. Martin lashed back that the judge was “humiliating him,” and that being “biologically male… shouldn’t matter,” because he was legally female.

The male sex offender further objected to Judge Feron reading out his criminal record during the appeal. He argued that there was a “prohibition on the use of evidence,” referring to legislation in the country on transgender individuals. “You mentioned my old name and my former gender,” Martin said to the judge. “There’s a fine for doing that.”

In April 2024, the German federal government passed the Self-Determination ACT (SBGG), which established “gender identity” as a protected characteristic. Along with allowing parents to change the sex marker on their children’s documents from birth, the SBGG created the potential for citizens to be fined up to €10,000 for referring to a transgender individual’s birth name or sex without their permission. The legislation went into force in November of that year.

While there is a carve-out for “special reasons of public interest,” including prosecution and linking someone to former convictions, for the disclosure of a trans-identified individual’s former identity, it is still technically possible for a judge to fall foul of the law. If they revealed the identity without relevancy, excessively, or outside the proper context, such as in casual remarks or comments to the media, they could potentially face the fine.

However, Judge Feron insisted that the child sex abuser shouldn’t be able to just erase his past.

“How is that supposed to work? Erase 38 years? You didn’t just fall from the sky,” Feron remarked during the appeal hearing. Lasting six hours, the defense attorneys attempted to move the discussion around the definition of what a woman was, with court-appointed lawyer Bert Albrecht arguing the term “sex” was legal not biological, and that therefore “a woman must search another woman.”

The prosecuting team focused purely on the insults, an argument that Judge Feron agreed with, rejecting the appeal.

Martin has now lodged his intention to take his case to the Federal Constitutional Court.

Multiple state justice ministries in Germany have allowed for the transfer of trans-identified male inmates to women’s prisons, resulting in reports that these inmates have sexually harassed or assaulted female prison guards and inmates.

In Vechta, a women’s prison in Lower Saxony, three sexual assaults were reported to have taken place by the same transgender perpetrator between 2023 and 2024. While the trans-identified male was not identified, it is known he had been convicted of the possession of child sexual abuse material. In North-Rhine Westphalia, another trans-identified male was involved in a physical assault on a female inmate.

One of the most egregious incidents that the survey learned of had first come to public attention in December of last year, when the Saxony state government finally admitted that throughout 2023 and early 2024, a trans-identified inmate had repeatedly ambushed and stalked multiple female inmates in the Chemnitz correctional facility, demanding sex and threatening to beat them if they didn’t comply. The man also repeatedly forced both female inmates and female correctional officers to watch him masturbate. According to the Freie Presse, the male inmate was eventually transferred back to a men’s prison.
