SPAIN: Man Convicted of Abusing Two Women Requests Pardon After Declaring Transgender Identity

A man in Spain convicted of violent crimes against two women has changed his name and sex marker in an apparent bid to seek clemency from the government on the basis of his newfound gender identity.

The man, located in Seville and identified in the media only as Antonio, changed his name to “Milan” in July and had his sex marker altered to female on his identification documents at the same time. As first reported by ABC de Sevilla, the man declared a transgender status after the Seville Court had sentenced him to 40 months in prison.

Now, after registering his new identity, Antonio is demanding the Government of Spain give him a total pardon because he says he “is a new person.”

The former private security employee was sentenced to 40 months in prison by the Provincial Court in Madrid following convictions from two criminal courts. The cases for both victims were initially heard by the Court for Violence Against Women in Seville.

The two victims, referred to in local press as Victoria and Patricia, have stated that they feel “unprotected and defenseless” after learning of their abusive former partner’s new identity and plea for clemency. The women say the situation is abnormal and that they are struggling to understand his change in gender identity.

Victoria had been Antonio’s girlfriend from 2017 to 2018, and was abused throughout the relationship. Antonio began dating Patricia in 2018, and Victoria attempted to warn her about the man’s violent behavior. Victoria said she wanted Patricia to know “what she was going to experience” after having endured the abuse herself.

Patricia and Victoria became friends, supported one another, and sought legal counsel. Defended by Attorney Maria Jose Atoche, the women decided to file complaints against Antonio on the same day in January 2019 citing injuries, coercion, humiliation, and mistreatment. 

In the case of Patricia, Antonio was given an eight-month “preventative imprisonment” sentence, meaning he would serve no jail time and instead be released into the community with a GPS tracking device. The requirement to wear the device expires next year. 

Antonio was given 40 months jail time for the abuse he committed against Victoria, and was also ordered to pay 8,000 Euros (approx. $8,500 USD) in compensation to her.

Both women have described Antonio as a “psychopath, manipulative, and very intelligent.” They have described their abuse as having been physical, psychological, and verbal. Antonio controlled what they could wear and who they could be friends with, and Victoria said he even destroyed her cell phone and damaged her car and home. 

Even after the victims filed their complaints in early 2019, they said Antonio continued to threaten them. 

In light of Antonio’s new name and “gender identity,” both Patricia and Victoria have expressed concerns over Spain’s recently-adopted gender self-identification legislation. The law, colloquially known as the Trans Law (Ley Trans), was adopted on February 16 this year amid mass criticism from women’s rights groups. Many stated that streamlining the process to change identification documents without medical oversight would result in abusive men exploiting the law to avoid culpability for their crimes.

Within months of the legislation’s passing, multiple cases have already emerged out of Spain in which violent males have taken to changing their names and gender markers in an effort to get preferential treatment by the justice system.

Last fall, a man who beat his female partner for opposing his transition successfully avoided charges of sex-based violence by legally changing his identification to “female” and adopting a woman’s name. Núria González López, the legal advisor for the victim, told Reduxx at the time: “Women’s safety appears to be less important than men’s feelings.”

In July, a sadistic man who bludgeoned his cousin to death before sexually desecrating her corpse requested transfer to a women’s prison after altering his identification and claiming to be female. Lorena Robaina, formerly known as Jonathan de Jesús, is currently serving 38 years in prison for the sick crime.

Most recently, it was revealed that a violent male convict who was transferred to a women’s prison after claiming to be transgender had reportedly impregnated a female inmate at the Alicante Cumplimiento Penitentiary Center in the Fontcalent region. The inmate was originally detained in the men’s ward of the Alicante prison for repeated violent criminal convictions, including kidnapping and robbery.
