La Unión Americana de Libertades Civiles dice que “Hombres y Mujeres” no existen

La Unión Americana de Libertades Civiles está interviniendo en una demanda presentada por cuatro reclusas sometidas a abusos de hombres identificados como trans que fueron trasladados a su prisión. En la intervención, la ACLU afirma que los seres humanos “no son sexualmente dimórficos”, y que no hay diferencias biológicas entre machos y hembras.

En noviembre de 2021, el Frente de Liberación de la Mujer (WoLF) interpuso una demanda contra el Departamento de Correcciones y Rehabilitación de California (CDCR) en respuesta al traslado de reclusos varones a prisiones de mujeres. En la demanda, WoLF incluyó representación legal para cuatro reclusas actualmente encarceladas en el estado que habían experimentado violaciones de sus derechos a manos de reclusos varones que habían sido transferidos bajo SB-132, una de las cuales fue agredida sexualmente por uno de los prisioneros masculinos que se identifica como trans.

En la moción, presentada el 9 de mayo en el Tribunal de Distrito de Fresno, la ACLU no solo rechaza los detalles en la demanda de WoLF, sino que también hace algunas afirmaciones audaces, incluida la de que los “hombres” y las “mujeres” no existen.

Viral TikTok Shows The Dark Side of Surrogacy

A US-based woman who entered into a surrogacy arrangement and gave birth to twins last year is now raising the children with her husband after the intended parents cut off contact.

In a TikTok that went viral, wracking up over 4 million views in a matter of days and sparking outrage, the mother, who goes by Amanda, revealed that she had been left to raise twins after the couple she had been a surrogate for never came to retrieve the children she had given birth to, and cut off contact with her.

Amanda had previously been a surrogate and decided to repeat the process. She registered with a surrogacy company that connected her with a couple who lived overseas. She gave birth to twins Hannah and James in February 2021, but the intended parents never arrived to pick them up. 

“They weren’t willing to quarantine for two weeks before entering the US,” Amanda explained.

Yet when COVID-19 restrictions were lifted in November last year, the couple still made no plans to come and take the children.

“I was okay taking care of them for a little while,” she wrote in the comments of her TikTok account. “But days turned into weeks and weeks into months… with no travel progress.”

Initially, the couple was sending money to Amanda and her husband to provide for the babies’ care. But after Amanda asked them not to send money if they had no intentions of taking the children, the intended parents ceased all contact.

In the viral TikTok video, Amanda explained that over 50 days had passed since they heard from the couple, and 14 months since she had given birth. Amanda, whose TikTok handle is @mom_11203, has since locked her account.

“Not only did they not pick up the twins – they never established their parental rights,” she explained.

Currently, both Amanda and her husband are listed as the legal parents on the twins’ birth certificate. The surrogacy contract had detailed that a second birth certificate would be drawn up when the parents arrived to take the infants home.

Amanda and her husband have hired a lawyer and have decided to raise the twins. “We ARE working with a lawyer. Yes, there was a legal contract in place,” Amanda said in a comment. “Our contract states that I am legally bound to give up my rights. But they’re also legally bound to come get their babies.”

She is determined to keep the twins even if the intended parents establish contact again and attempt to pick them up. “I will not give them up without a fight,” she said.

Jennifer Lahl, founder and president of The Center for Bioethics and Culture Network, has combined her experience as a pediatric critical care nurse with her advocacy against the surrogacy industry. She has also produced several documentary films exposing the medical harms involved in the surrogacy process and highlights the personal stories of women who have been harmed.

Speaking with Reduxx, Lahl explained that though she had never spoken with women who had been abandoned by the intended parents, she has often seen cases where the intended parents demanded that the surrogate mother terminate a pregnancy or reduce the number of fetuses she is carrying.

“Never has the surrogate done this, but what they struggle with after giving birth is wondering whatever became of the babies. Did the intended parents keep the babies, give them up for adoption, or keep one but not all. This is more common than intended parents never coming to claim their babies,” Lahl said.

“In some U.S. states, the surrogate mother’s name is on the birth certificate when the baby is born and the intended parents have to go through a legal adoption. But in states like California, New York, and Washington, the surrogate waives her maternal rights at the signing of the contract, before she is even pregnant, and in this case, she would have to go through a formal adoption to legally become the mother of the child.”

Lahl, who has over a decade of experience working with women who were involved in surrogacy contracts and has spoken at the United Nations on the topic, went on to describe why she believes the industry is inherently exploitative.

“The industry, what I call Big Fertility, preys on women’s financial need and sense of altruism to help others have a family. They ignore the risks to women’s health, they groom women ⁠— you aren’t pregnant, you are on a ‘journey’ ⁠— to comply and obey. When things go wrong, they are last in line to help these women,” Lahl says.

“Bottom line, they are selling a product: a healthy baby. Their customer is the wealthy intended parent.”

UK: Trans-Identified Male Jailed After Pleading Guilty to 21 Child Sex Offences

A man who identifies as a woman has been jailed for 10 years after pleading guilty to using social media to groom children for sexual abuse.

Richard Fenton, who identifies as ‘Rachel,’ has been sentenced to 10 years after pleading guilty to 21 total child sex offenses, including seven counts of attempting to incite a child under 13 to engage in sexual activity. Fenton was also charged on a drug offense.

According to Manchester Evening News, Fenton was originally reported to police in November of 2021 after an anti-predator vigilante group informed law enforcement the had been communicating with a fake social media profile they had established in the likeness of a 12-year-old girl.

Not knowing who was behind the profile and believing it to be a child, Fenton attempted to incite the ‘girl’ into sexual activity, and sent the profile perverted images.

Fenton also tried to encourage the ‘girl’ to engage in sexual activity with a six-year-old. Police soon after arrested him at an address in Wythenshawe on suspicion of attempting to sexually abuse a child, also charging him with marijuana possession.

The 45-year-old man was then released on bail, where be quickly began communicating with yet another fake profile, this one established by law enforcement. The profile was one he believed to belong to a 12-year-old girl, and Fenton sent the account indecent images and encouraged the fake child to engage in sexual activity. Fenton also contacted a third fake profile and engaged in similar behavior.

Fenton was re-arrested in January of 2021 on a total of 21 offenses, to which he pleaded guilty at Manchester Crown Court on Monday. Fenton was also issued a sexual harm prevention order, and made to register as a sex offender.

According to sentencing information, Fenton is listed as a male under his birth name and the court records utilized masculine pronouns for him, which indicates he does not have a gender recognition certificate (GRC). Despite this, many media outlets opted to validate Fenton’s identity, calling him “Rachel,” and utilizing gender-neutral language to address him.

The lack of ‘affirming’ information within court records also suggests Fenton would not be sent to a female prison immediately.

Speaking to Reduxx on the case, Dr. Kate Coleman, Director of Keep Prisons Single Sex, says the primary concern is if Fenton chooses to apply for a GRC and cement his transgender identity in law.

“[GRCs] have successfully been obtained by prisoners serving sentences for the most serious violent and sexual offenses against women and children,” Dr. Coleman says, “We know that offending history and risk are not taken into consideration by the Gender Recognition Panel when making the decision to grant a gender recognition certificate.”

Keep Prisons Single Sex is a campaign group focused on advocating for the single-sex rights of vulnerable female inmates. It currently has branches in the United Kingdom and United States.

Dr. Coleman notes that male inmates serving long sentences may be motivated to begin to fulfill the requires for a GRC and apply.

“What else is there to do?” She asks, pointing out that a GRC would be beneficial if the offender is habitual and knows they are likely to wind up in prison again.

“Whilst under 1% non-GRC holders are in the female [prison] estate, 90% of those with a GRC are in women’s prisons. These include those convicted of the most serious violent and sexual offences and those with intact male genitalia,” Dr. Coleman says, continuing: “A GRC isn’t a cast iron guarantee of getting into a women’s prison, but it increases your chances by an order of magnitude.”

On Fenton, Dr. Coleman says a GRC would possibly be of particular advantage.

“A GRC would confer an additional advantage for this prisoner, which is that he will then be risk assessed only using the risk assessment tools for female offenders. This is significant because he has been convicted of a sexual offense – a GRC would mean that the risk assessment tool designed for use with adult male sexual offenders can never be used with him again.”

Trans-Identified Male Charged on 13 Counts of Sexual Abuse of Children

A trans-identified male who pleaded not guilty to attempted child sexual abuse in March is facing additional charges.

Jude ‘Babs’ Longmire, 41, of Billings, Montana, pleaded not guilty last Friday in Yellowstone County District Court to sexual abuse of children, attempted sexual abuse of children, and 11 alternative counts of sexual abuse of children.

On March 15, Longmire was arrested for having been in contact with someone online who he had believed was trafficking a 12-year-old girl for sexual abuse. Longmire attempted to schedule a meeting with the child. Court documents state that during this exchange, Longmire shared a video of a man raping a child.

Longmire also allegedly boasted that he had more child sex abuse material, and in the course of the conversation said that he had an extensive child sexual abuse materials collection which ranged from “really young to mid teens, boys and girls.”

A search warrant was granted to the FBI on March 14. Longmire was placed in custody at Yellowstone County Detention Facility, and federal agents conducted a search of his residence the next day.

Longmire was initially charged with attempted child sex abuse, sexual abuse of children and an alternative count of sexual abuse of children, to which he pleaded not guilty on March 17.

When FBI agents extracted data from Longmire’s cell phone and SD card in April, they recovered more than 100 images and videos of actual and computer-generated child sex abuse material.

Data from Longmire’s electronic devices suggested that he had been sending the images and videos to others from the period of late January through early March, with authorities alleging he shared the child sexual abuse materials at least 10 times.

According to the most recent police documents, Longmire is alleged to also have told one of those recipients in February that in the upcoming weeks, he was planning on raping a 12-year-old girl.

In light of the new information uncovered by investigators last month, charges against Longmire were amended from one count alleging he shared a video of a child being raped to 11 counts of sexual abuse of children, accusing him of possessing and distributing child sex abuse material, bringing the total count of charges to 13.

If convicted of distributing child sex abuse material, Longmire could face a sentence of life in prison without the possibility of parole for the first 25 years.

He is currently in custody at Yellowstone County Detention Facility on a $250,000 bond.

Media reports on Longmire’s crime referred to him by ‘she/her’ pronouns, and did not mention he was transgender. But Longmire prominently features photos of himself and the transgender flag on his Facebook, and declared he had started hormone replacement therapy in 2018 on his Instagram.

Barbie Kardashian Found Guilty Of Threatening to Rape, Murder Mother

A notorious Irish criminal is has been found guilty of threatening to sexually assault and murder his mother.

Barbie Kardashian, born Alejandro Gentile, had pleaded not guilty to the charges, which initially included 11 total counts of threatening to kill or cause serious harm to his mother and a care worker at Coovagh House, the secure facility for children he had been staying at since being remanded to special care in 2012.

Kardashian was found not guilty on the four charges related to threats issued towards the care worker. but guilty on all seven counts of those towards his mother.

At the trial which took place last week, the former Deputy Social Care Manager from Coovagh House took the stand to testify, outlining that on multiple occasions in 2020, Kardashian had expressed a desire to rape and murder his mother.

“[He] clearly expressed [he] wanted to track her down, identify where she lived and kill her – to murder and rape her,” the witness stated, continuing that on a separate occasion, Kardashian “expressed a clear desire to rape and mutilate [his] mother’s genitals.”

The witness also noted: “It was a clear desire to murder [his] mother, [he] had a plan to do so and was frustrated that [he] no longer knew where [his] mother lives.”

Kardashian, 20, came under widespread notoriety in September 2020 after it was discovered he was being housed in the women’s section of Limerick Prison after being arrested for uttering the rape and murder threats he is now standing trial for.

Kardashian was the victim of sustained childhood abuse at the hands of his father, who also directed depraved abuses at his mother.

As a child, Kardashian’s father had prevented his mother from breastfeeding or holding him when he cried. The father physically and emotionally abused him throughout childhood, but eventually recruited him to join in the abuse of his mother.

In 2010, Kardashian’s mother fled with him to a domestic violence refuge. Aged 8 at the time, Kardashian would be taken into special care just two years later after carrying out a brutal attack against his mother. She was forced to move to another part of the country as Kardashian continued to express plots to rape and torture her.

In 2019, Kardashian failed to appeal the special care order, but was released in 2020 after turning 18 and aging out of the secure care unit for children he had been held in.

At the time, Gardaí issued a nationwide alert to members of the public to a “homicidal teenage girl” that was set to be enter the community, failing to mention Kardashian had changed his legal gender marker just weeks before he was set to be released and was not a biological female.

Despite the fact Guardaí were attempting to warn the public of Kardashian, news outlets were prevented from providing too many details on Kardashian’s identity, and platforms reporting accurate details on his appearance, sex, and history were censored. Gript Magazine, an independent Irish outlet, was forced to remove an article describing Kardashian as male.

Today, almost all outlets covering Kardashian’s verdict continued to affirm his identity, utilizing ‘she/her’ pronouns to address him. In an article published by the Irish Times, it was even insisted that Kardashian had a “certificate from the Department of Social Protection which recognizes [he] is female.”

The onslaught of headlines describing Kardashian as a “woman” left some people expressing disbelief and upset on social media.

To one article posted by NewstalkFM, many feminists took to utilizing the hashtag #notourcrimes to indicate displeasure with Kardashian’s actions being associated with women.

Other users noted the confusing logic behind both the media and court validating select components of Kardashian’s identity while ignoring the rest under the recognition that he was obviously mentally ill, having been diagnosed with narcissistic personality disorder.

“This man is incredibly sick, hates his mother and wants to kill her, and brutally attacked a female care worker. But the fact he identifies as female and wants to be called Barbie Kardashian – that’s just fine to the law and the mental health “professionals” working with him,” journalist and activist Eva Kurilova wrote.

Kardashian had been held in the women’s section of Limerick Prison after being charged in 2020, and, if sentenced to prison time, may also be transferred to a women’s facility in accordance with Irish self-identification law. This is despite the fact he is not only violent, but has a particular affinity for brutalizing women.

After being admitted to secure care in 2012, Kardashian displayed “sexualized” and violent behavior towards female staff from the early age of 10.

According to court documents from 2018, at 13 years old, Kardashian attacked the female driver who had been transporting him from court after appearing on a bench warrant. Without warning, Kardashian grabbed the woman from the backseat, tore off her eyelids, and ripped out clumps of her hair. 

After the incident, Kardashian expressed regret at having failed to kill the victim, telling Gardaí – the Irish national police – that it had been “music to [his] ears to hear [the care worker] scream and cry.” 

In relation to today’s guilty verdict, Kardashian will be sentenced in late July. According to NewstalkFM, the Judge has apparently ordered a psychological assessment to be completed before then.

Destacado transactivista es arrestado por abuso sexual de un adolescente

Un destacado activista trans cuya desgarradora historia de discriminación por identidad de género fue publicada en The New York Times, se enfrenta a 16 cargos por delitos graves relacionados con el abuso sexual y la extorsión de un adolescente.

Carlos Arturo Aparicio Hernández, de 36 años, fue acusado la semana pasada de extorsión sexual agravada y seis cargos de sodomía forzada como delitos graves de primer grado, y tres cargos de abuso sexual por la fuerza, seducir a un menor, y cinco cargos de explotación sexual de un menor como delitos graves de segundo grado, todos relacionados con el abuso de un adolescente en 2021.

En enero del año pasado, la víctima de 15 años aceptó una solicitud de amistad en Facebook de alguien que él creía que era una chica de su misma edad. Hernández se comunicó con el niño durante varios meses y se ganó su confianza, y finalmente le pidió fotos desnudo.

EXCLUSIVE: Prominent Trans Activist Arrested on Charges of Sexually Abusing Teen Boy

A prominent trans activist whose harrowing story of gender identity discrimination was featured in The New York Times is facing 16 felony charges related to the sexual abuse and extortion of a teen boy.

Carlos Arturo Aparicio Hernandez, 36, was charged last week with aggravated sexual extortion and six counts of forcible sodomy as first-degree felonies, and three counts of forcible sexual abuse, enticing a minor, and five counts of sexual exploitation of a minor as second-degree felonies ⁠— all concerning the 2021 abuse of a teenage boy.

In January of last year, the 15-year-old victim accepted a friend request on Facebook from someone he was led to believe was a girl of his own age. Hernandez communicated with the boy for several months and built trust, eventually requesting nude pictures from him.

After receiving the photos, Hernandez requested to meet the victim, inviting him to a home in Taylorsville, Utah.

Hernandez then blackmailed the boy with the photos he’d sent while they had been communicating before sexually assaulting him. According to court documents, Hernandez also recorded the sexual assault.

The victim told police Hernandez had also showed him sexually exploitative images of “very young” girls and told him that he had sexually abused them as well.

Upon arrest, Hernandez waived his Miranda rights and told police that he had been attracted to minors since he was young. He also said his purpose for meeting with the boy was to sexually abuse him.

According to the Salt Lake County Sheriff’s Department, Hernandez was booked as a female under his legal name, but provided an alias of Raiza Daniela Aparicio Hernandez. He was also recorded as being a citizen of El Salvador.

On Sunday, May 8, a Reduxx staffer visited Hernandez at Salt Lake City Metro jail in order to confirm his identity as a prominent trans activist who was once featured in The New York Times, and even spoke at the Canon House Office Building in Washington, D.C. on LGBTQ migrants.

In his home country of El Salvador, Hernandez was active in the trans activist community and served on the Board of Directors of the Asociacion Aspidh Acoiris Trans (AAAT), a political organization which advocates for trans-identified males.

Hernandez’s top-level role with AAAT saw him representing the LBTQ community at various events, marches, political meetings, and even the Inter-American Court of Human Rights in Costa Rica, where Hernandez lobbied for self-identification laws.

The IACHR has jurisdiction over 25 of the 35 member nations of the Organization of American States (OAS). Hernandez visited the Court in 2016 to promote making self-identification laws more widespread. In 2018, the IACHR declared that “the change of name and the rectification of public records and identity documents to conform to a person’s gender identity” are protected rights. Just last year, the IACHR ordered the government of Honduras to implement policies that would facilitate gender self-identification and the falsification of biological sex on official documents.

In February 2017, Hernandez was seen with Hugo Martinez, who was El Salvador’s Minister of Foreign Affairs at the time. Hernandez had lobbied Martinez for support on self-identification laws.

In 2018, The New York Times profiled Hernandez in an article on the obstacles faced by LGBTQ migrants.

In the piece, Hernandez was described as a “transgender human rights activist” who had left El Salvador in June of 2017 after facing harassment and physical assault by police. Hernandez would be granted asylum in the United States that same year, and settle in Los Angeles.

Hernandez’ case was go on to gain notoriety amongst activists, with him being invited to give a speech at an event held by the Council for Global Equality at the Cannon House Office Building in Washington, D.C. During the event, Hernandez claimed to have experienced discrimination on the basis of his sexuality and gender identity by Immigration and Customs Enforcement staff.

In March 2020, Hernandez spoke at the University of Southern California (USC) school of law on the topic of “Asylum, Disability and Mental Health.”

While meeting with Hernandez, Reduxx was able to confirm he is being held in the female section of the Salt Lake City Metro Jail. Hernandez said he had family in Utah, though his permanent address is still listed as being in Los Angeles, California, where he resided after being granted asylum.

Hernandez is currently awaiting trial on his charges, but did reportedly admit to police that he committed the assaults against the teen boy.

Las Vegas Strip Club Hiring “Ukrainian Strippers”

A strip club is Las Vegas is sparking discussion and disbelief after apparently taking advantage of the crisis in Ukraine to advertise for hiring Ukrainian refugee women.

On May 8, Sputnik reporter Wyatt Reed posted a photo to Twitter of the mega-signage outside of Little Darlings, which describes itself as the “consistently voted the #1 adult club in Las Vegas.” Reed captioned the snap, “the West’s “solidarity” with Ukraine truly has no limits.”

The sign, which is clearly visible from the Nevada Interstate 15, read “Now Auditioning Ukrainian Strippers,” on a Ukraine-flag backdrop, and a sub-caption that said “We Stand With Ukraine.”

Wyatt’s tweet has since wracked up thousands of likes, with many users expressing disbelief as to whether the signage was real, or just a distasteful meme.

But Las Vegas residents have been reporting seeing the sign since mid-April, with multiple posts on Reddit showing different pictures confused onlookers have snapped of it.

On April 15, Reddit user u/Bubbalicia posted a photo of the sign taken during the day from the Interstate 15 to the r/AwfulEverything community, wracking up over 1,700 ‘upvotes’ and sparking discussion in the replies.

“This club is known for hiring girls that are 18-21, we all know it’s a total sleazefest. This is nothing new,” one user replied, with another saying: “This is very immoral, basically increasing human trafficking since Ukrainian woman are at their most vulnerable.”

While most users were quick to understand the problems inherent in the signage, some attempted to write it off as a facet of consensual ‘sex work.’

“Classic conservative, calling any kind of sex work sex trafficking,” u/Arkenheim wrote in response to a user who called Little Darlings’ actions immoral, going on to say: “It just gives them more opportunity and there must be a decent-sized Ukrainian population there (Vegas?), it’s not like they are forcing anyone to strip for them. We are all prostitutes really, we just sell different parts of ourselves.”

This isn’t the first time Little Darlings has turned heads with its signage, with the club being notorious for advertising for high school and college students. It also came under widespread scrutiny after it refused to shut down in March 2020 at the beginning of the coronavirus pandemic. It then began offering “drive-thru strip shows,” and advertising “coronavirus free lap-dancers.” Despite being an adult club, Little Darlings does not serve or allow alcohol on the premises in order to maintain its ability to hire the youngest women legally possible.

As Reduxx has previously reported, Google searches for terms such as “Ukrainian girls,” “Ukrainian porn,” and “war porn” spiked during the first week of the conflict. Likewise, the top trending searches on PornHub included “Ukraine” and “Ukrainian girl.” Other porn sites like XVideos also saw marked increases, with tags such as “Ukraine teen” and “Ukraine prostitute” adding thousands of new videos in those categories.

The surge in fetishization of Ukrainian women has continued in nations like Ireland, where some escort sites have reported a 250% increase in men seeking women of Ukrainian origin

In March, a transgender-run “sex work” organization in Germany was slammed for soliciting Ukrainian women who might be interested in entering the country’s legal sex trade, with a brothel in Austria offering accommodation to Ukrainian women and children shortly after.

Toddler-Killer Quietly Moved to New York Women’s Prison

A trans-identified male convicted of torturing and killing a 4 year-old boy has been quietly transferred to a women’s prison in New York state. Christopher “Kryzie” King was serving a sentence of 22 years to life in Clinton Correctional Facility until April 20, when he was relocated to the Bedford Hills Correctional Facility for Women.

King pleaded guilty to abusing and murdering 4-year-old Myls Dobson in 2014. The child had been left in his care after his father, Okee Wade, was arrested.

Myls had been removed from the custody of his abusive mother, Ashlee Dobson, in 2012 and placed with his father despite Wade’s long history of incarceration and sexual assault. The city’s Administration for Child Services only monitored Myls for a year before closing his case in late 2012, just months before his father would be detained on charges of bank fraud.

Wade left Myls with King, though he would later claim he didn’t know the transgender ‘babysitter’ at all.

Investigators told the press that during the three weeks Myls was in King’s care, he regularly beat the toddler, even whipping him in the head with a belt buckle, burning him, and locking him outside on a balcony in his underwear in the freezing cold. King also starved Myls, reportedly giving him a last “Christmas meal” on December 26th. During the few weeks King tormented the toddler, officials say he lost 14 pounds.

When an autopsy was carried out on Myls, the boy had not eaten for weeks. To the burns covering Myls’ body, King admitted to torturing him with an oven rack, heating up the hot metal before removing it with an oven mitt and pressing it up against the boy’s leg. 

Assistant District Attorney Nicole Blumberg also said that King “bound and gagged” Myls as a form of punishment.

On the day the boy died, Myls had asked King to go to McDonald’s. In response, King beat him and locked him in a bathroom. The boy suffered fatal injuries after falling off a counter and into an empty bathtub. King waited nearly 24 hours after the death before contacting emergency services.

After his arrest in 2014, King attempted to blame the abuse on the child’s behavior. “He’s becoming increasingly more difficult,” King wrote.

“Before I beat him, I told him to pull his pants down and might have hit him in the privates and not known it,” he continued. “I gagged him to keep him from screaming. I then put him in the bathroom with the lights out and locked him in the bathroom for 2-3 hours.”

During his sentencing in 2016, King’s lawyer, Bryan Konoski, speaking on his behalf, told the judge that he was concerned that the New York State Department of Correctional Services would force him to cut his hair. 

“[His] hair is very important to [his] identity as a transgender individual,” he said. “[He] asks that the corrections department refrain from cutting [his] hair.” Myls Dobson’s family expressed outrage at the request.

Media reports from the time of King’s arrest and conviction describe him as a “woman” and use female pronouns to refer to him.

In January, New York Governor Kathy Hochul introduced a policy directive, tacked onto a $216 billion budget plan, that would allow inmates who self-declare a gender identity to choose where they are incarcerated.

King’s transfer to the women’s facility was done quietly, with no media coverage or public disclosure being provided. Within the New York State Department of Corrections system, King received a new identification number on April 20, which designated him as ‘female’ and distinguished him from his old ‘male’ identification number. He was also listed as ‘released’ from Clinton, but ‘in custody’ in Bedford Hill – a women’s facility.

Policies which allow males to be transferred into women’s prisons have resulted in some female inmates being forcibly locked up with violent killers and sex offenders who identify as transgender.

Speaking to Reduxx on King’s transfer, Kara Dansky cites the Nelson Mandela Rules established by the United Nations which has long-established single-sex correctional facilities as a necessary human right.

Dansky is the President of the United States chapter of Women’s Declaration International, a network of women across the globe advocating for the defense of women’s sex-based rights.

“Incarcerated women, disproportionately women of color, are often survivors of domestic and/or sexual assault,” Dansky says, “Forcing them to share locked prison cells with men is a form of abuse.”

Dansky points to the recent pregnancies in a New Jersey women’s prison, as well as the sexual assault which occurred in the women’s section of Riker’s Island after a trans-identified male inmates attacked a female detainee in the shower room.

“Some women are reporting that they have to sleep in shifts, keeping watch over the male prisoners in an effort to protect themselves and each other.”

Dansky notes that 49 states plus the District of Columbia have some policies allowing the transfer of males into women’s prisons on the basis of self-identification, moves she says have gone under the radar due to a lack of transparency.

“This has occurred without public knowledge, because government entities do not address it publicly and most media outlets refuse to report on it.”

Currently, Bill S6677A, which would enact a “gender identity respect, dignity and safety act,” has been introduced and is awaiting a vote in the Senate. It establishes that “incarcerated individuals shall be presumptively placed in a correctional facility with persons of the gender that most closely aligns with such person’s self-attested gender identity.”

While the bill has not yet been approved, New York City has had policies in place since 2018 that houses inmates based on their self-declared gender identity unless the outcome of a federally required safety assessment or the preferences of the inmate require alternative housing.
